Terms of Service

1. The Service

Tidel reviews Etsy listings and provides optimisation suggestions for titles, tags, descriptions, and photos. The Service is currently in private beta and provided free of charge during this period.

2. Beta Program

Because we're in beta:

• Features may change, break, or be removed without notice.
• The Service may experience downtime, data loss, or unexpected behaviour.
• We make no guarantees about availability or performance during the beta period.
• Beta access may be revoked at any time at our discretion.
• Beta access is currently gated by a shared password issued to invited reviewers. Sharing that password with anyone outside the beta program is not permitted.

3. Your Account

You are responsible for safeguarding the beta access password issued to you and for any activity that occurs under your access. You must provide accurate information when corresponding with us and keep your contact email current.

4. Etsy Integration

When you connect your Etsy shop, you authorise Tidel to access your listing data through the Etsy Open API v3. You represent and warrant that:

• You own or are authorised to manage the Etsy shop you connect.
• Your listings comply with Etsy's terms of service and applicable law.
• You will not use Tidel to generate content that violates Etsy's policies (including prohibited items, misleading claims, or infringing material).

Tidel is an independent service. We are not affiliated with, endorsed by, or sponsored by Etsy, Inc. "Etsy" is a registered trademark of Etsy, Inc. Use of the Etsy API is subject to Etsy's own API Terms of Use, which apply in addition to these Terms.

5. AI-Generated Suggestions

Tidel provides AI-generated suggestions to help you improve your listings. These suggestions are informational. You are solely responsible for reviewing and approving every change before publishing it to your Etsy shop. We do not guarantee that suggestions will improve your sales, search ranking, or visibility, and we are not responsible for the outcome of changes you choose to apply.

6. Acceptable Use

You agree not to:

• Use the Service to generate misleading, deceptive, fraudulent, or trademark-infringing listing content.
• Use the Service to violate Etsy's policies or any applicable law.
• Reverse-engineer, scrape, or extract the AI models or algorithms behind the Service.
• Attempt to circumvent rate limits, security measures, or access restrictions.
• Share or publish the beta access password with anyone outside the beta program.

7. Intellectual Property

You retain ownership of your Etsy listing content. Suggestions generated for you by Tidel are provided under a perpetual, royalty-free licence to use as you see fit. Tidel retains all rights to its software, prompts, algorithms, and design. Nothing in these Terms transfers ownership of Tidel's intellectual property to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect, how we use it, and your rights.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Tidel and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost sales, lost profits, lost data, or negative changes to your Etsy shop performance. Our total liability for any claim relating to the Service is limited to fees paid by you in the 12 months preceding the claim (which, during the free beta, is zero).

11. Termination

You may stop using the Service at any time by signing out and discontinuing use. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Upon termination, we will delete cached Etsy data within 30 days unless required by law to retain it.

12. Changes

We may update these Terms from time to time. Material changes will be announced via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Tidel is operated. Any dispute that cannot be resolved informally will be brought exclusively in the courts of that jurisdiction.
